In February of this year, the IP High Court in Perfetti Van Melle S.p.A v Rakuten handed down a ground breaking decision regarding an online shopping mall operator's duty to take down infringing materials sold by third party store owners selling goods via the online mall. The decision of the IP High Court was the first ever in Japan to address the duty and potential liability of an Internet mall operator with respect to the sale of infringing goods by third party online store owners. In its decision, the court also enumerated the conditions under which the mall operator would be liable for trademark infringement for sales by such third party store owners. Messrs Tanaka and Watanabe of Nakamura & Partners who represented Perfetti Van Melle S.p.A in the litigation will provide and overview the case and discuss the conditions set by the court and the effect on retail markets.
